How to get a Building Permit in India- Application, Documents, Plans

Building permits are required for all building development activities such as building construction, reconstruction, demolition and major alterations. This article will help you to understand the application process, documents and other related matters for obtaining a building permit in India. The information given in this article are in compliance with BIS National Building Code (NBC).

Annexure forms, Plans and Statements

As a first step, the owner who wishes to carry out building related activities should submit the following annexures, plans and reports in three copies to the building authorities with the assistance of an engineer.

If height of the building is more than 15m, approval from the fire service department is required. Permission of Airports Authority of India, Ministry of Environment and Pollution Control Board is required for construction of tall buildings and special buildings.

Building Permit Approval Process

Development/building approval committee has a team of representative body of building officials to verify and issue building permits. After submitting the application form along with relevant documents, the building officials will verify and issue first response/invalid notice/non-compliance intimation notification within 30 days.

The approved permit is valid for a period of three years only, and a new permit is required to proceed with the building activities beyond that.

Preparations and Signing of Plans

Building plans must be duly signed by a registered architect / engineer / supervisor and other registered professionals. Plans should include the name, address, qualification and registration number of the professional. All plans must have the owner’s name, address and signature.

Structural plans shall be prepared and duly signed by the registered engineer/structural engineer. 

Building Alteration

For Major Alteration to the building requires approval from the authorities.

For Minor alterations, such as those given below, no permits or approvals are necessary

  1. Alteration in openings, closing of windows or doors or ventilators.
  2. Providing partitions, false ceilings, sunshades.
  3. Gardening and minor landscape works
  4. Whitewashing, paining
  5. Re tilling, re-roofing, re-flooring, Plastering

Approval Fees

Admission fee is charged for the consultation. If the application is rejected due to any violation, the owner may resubmit for approval within one year of the denial.

Approval or refusal?

Authorization will be approved or denied by the authority within 30 days of application.

Authorities may give Sanctions with modifications, suggestions or directions which should be followed during construction.

In case of refusal, authorities will mention the reason and will point out the contradictions with the relevant code or NBC. All the objections by the authorities will be mentioned on the first refusal to prevent confusion and delay of the project. The application can be resubmitted after fulfilling the requirement of code mentioned by the authorities. 

Any changes in plans, statements and specifications after the issue of building permit should be intimated to the authorities in earnest to the actual construction. 

The good news is that if the authorities do not respond properly within the first 30 days of submitting or re-submitting the application online, the application will be deemed approved.

Sanction revocation

Sanctioned approval can be revoked by the authority if any false information was found during actual construction.
